Covenant Enforcement Issues

Restrictive covenants serve as an agreement among neighbors to maintain certain minimum standards related to the appearance and use of each property. The benefits of restrictive covenants become clear when a neighbor fails to comply to the point that your personal sense of comfort is offended. When this happens, it is important to have an objective and neutral party to administer and enforce the covenants equally across the neighborhood to ensure continuity of appearance. While the vast majority of property owners comply with restrictive covenants, it is necessary, on occasion, to enforce such restrictions for the betterment of the community as a whole.

Over the years the District has served as the primary enforcement mechanism for restrictive covenants for many subdivisions within the District because these subdivisions do not have organized homeowner's associations with the legal power to take such action. The District has reminded residents of compliance issues on hundreds of occasions, and taken enforcement action when absolutely necessary. Below are photographs of some examples of violations from the District's files. Without an enforcement vehicle in place, these types of issues can go unchecked, and begin to erode the quality of the neighborhoods within the District.
